The Travelex Foreign Coin Services mobile application for Google Android and Apple iOS mobile phone operating systems (the "App") is operated by Travelex Foreign Coin Services Limited ("Travelex" or "us" or "our") on behalf of itself and its holding companies and subsidiaries (together the "Travelex group"). Use of the App is provided only in accordance with the terms set out below (the "Terms"). Please read the Terms carefully before you start to use the App.
1. Use of the App
1.1 By installing or using the App, you agree to be bound by these Terms. Use of the App is also subject to the Travelex Online Terms and Conditions which can be read here.
1.2 If you do not agree to these Terms, please refrain from using the App.
2. Data Protection
Any personal information you supply to Travelex when using the App will be used by Travelex in accordance with its Privacy Policy which can be viewed here.
3. Licence
Travelex grants you a worldwide, non-exclusive, royalty-free revocable licence to download and use the App for your personal, non-commercial use in accordance with these Terms.
4. App Content and Materials
The information, materials and services contained in the App are subject to change from time to time without notice. Not all products and services are available in all geographic areas. Your eligibility for particular products and services is subject to final Travelex determination and acceptance. Travelex may discontinue or make changes to the information, products or services described herein at any time. Any dated information is published as of its date only, and Travelex does not undertake any obligation or responsibility to update or amend any such information. Furthermore, by offering information, products or services via the App, no solicitation is made by Travelex to any person to use such information, products or services in jurisdictions where the provision of such information, products or services is prohibited by law.
5. Links to Other Sites
Links to third party websites or applications (“Third Party Sites”) are provided solely as pointers to information on topics or services that may be useful to users of the App, and Travelex has no control over the content or services on such Third Party Sites. Links to Third Party Sites do not imply any responsibility for the opinions, ideas, products, information or services offered on such sites or endorsement thereof, or any representation regarding the content on such sites. These links are provided to you as a convenience only. In accessing Third Party Sites or information you are subject to the Third Party Site terms and conditions of use and privacy policy. You acknowledge sole responsibility for and assume all risk arising from your use of Third Party Sites and are responsible for complying with the terms of use of those Third Party Sites. Travelex makes no warranties, either express or implied, concerning the content of Third Party Sites and Travelex accepts no liability for any losses suffered from the use of Third Party Sites.
6. Currency services
6.1 The App allows users to purchase foreign currency banknotes through Travelex Online. A purchase of foreign currency banknotes is subject to the Travelex Online Terms and Conditions, save for the following differences:
6.2 Your time spent using the App is not time-limited. Exchange rates may move from the beginning of your search within the App to when you pay. However, you will be asked to confirm the final rate prior to committing and paying for your order.
6.3 You can only buy foreign currency banknotes from the App at this time.
6.4 We cannot offer Office Delivery for orders placed on the App.The currency exchange rates displayed on the App are loaded via the Travelex Online Service, and are subject to change at any time without notice.
6.5 Certain functions of the App are available to use when you are not connected to your data provider, but you should be aware that the information displayed, including currency prices, will not be live or real time information and may differ from the real time information.
6.6 The App’s ‘spending recommendation’ function should be treated as an indicative guide only, based on consumer research commissioned by Travelex and actioned by a 3rd party research agency.
7. Intellectual property
7.1 Copyright, database rights, trademarks and other intellectual property rights of any nature contained in the App, including but not limited to all software, design, text, images, sound recordings, animations and video sequences, are owned or licensed, except as otherwise expressly stated, by Travelex.
7.2 You may access the App for your own use of the facilities offered. You may not otherwise copy, transmit, display, perform, distribute (for compensation or otherwise), license, alter, store, reproduce, unzip, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the App or any of its content.
7.3 At no point are you permitted to use any App content for commercial purposes without the prior written consent of Travelex.
8. Trademarks
"Travelex™" and "The Worldwide Money Logo™" are registered trademarks of the Travelex group. Other featured words or symbols, used to identify the source of goods and services, are the trademarks of their respective owners.
9. Changes of Terms
9.1 We may, at any time and with immediate effect, change, suspend or withdraw the App and these Terms without notice and without liability to you. If we revise these Terms, we will post the revised version on the App. You are expected to check our App Terms and Conditions from time to time to take notice of any changes we make, as they are binding on you. By using the App or the Service or by placing orders after we have changed these terms, you will be accepting the changes.
9.2 These App Terms and Conditions were last updated on 30th June 2015.
9.3 The App is currently made available to you by Travelex free of charge, however your mobile operator may charge you for accessing the App. Travelex reserves the right to amend or withdraw the App, or charge for the App any time.
10. Updates
From time to time we may issue updates to the App which may affect your use of the App. These will be made available through the Apple App Store and Google Play Store and we recommend that you download and install all updates issued. We do not accept any liability for loss of use or loss of access to the App on the issuance of an update.
11. Availability
11.1 The App is currently available to mobile devices running the Apple iOS Operating System and Google Android Operating System. The App is provided over the internet and mobile networks and Travelex has no control over the availability of the App.
11.2 Travelex and its sub-contractors do not accept any responsibility whatsoever for unavailability of the App, or any difficulty or inability to download or access content or any other communication system failure which may result in the App being unavailable.
11.3 Certain functions of the App are available to use when you are not connected to your data provider, but you should be aware that the information displayed without a data connection will not be live or real time information.
12. Limiting Our Liability
12.1 All content and services on or available through the App are provided on an "as is" basis and Travelex does not make any representation or give any warranty of any kind (implied, statutory or otherwise) in respect of the App or its content. In particular, Travelex does not give any warranty as to the accuracy, suitability, reliability, completeness, performance, fitness, freedom from viruses or other harmful content or timeliness of the content or services contained on the App.
12.2 The information services on the App are intended for use by holiday or business travellers or by individuals or companies seeking to purchase foreign currencies, and should not be used for speculation or investment. These information services and other content of the App are not intended to amount to advice on which reliance should be placed. We accept no responsibility or liability arising from any reliance placed on such services by any user of the App or by anyone who may be informed of any of its contents. In addition, we give no assurances that you will receive the services for which you register.
12.3 You acknowledge and agree that in entering into these Terms you do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to these Terms or not). Nothing in these Terms shall, however, operate to limit or exclude any liability for fraud.
12.4 We use reasonable care and skill in providing the Service. However, we shall not be liable to you for the following:
(a) any direct loss or damage arising from or connected to the App;
(b) any indirect, or consequential losses, claims or damages suffered by you or incurred from your use of the App or the services provided however caused;
(c) if we are unable to perform any of our obligations to you due to failure of any technical systems or for any other reasons beyond our reasonable control including, amongst other things, war, terrorism, government action, natural disaster, and industrial dispute;
(d) any damage to your mobile device equipment as a result of using the App or the Service; or
(e) any loss of information or unauthorised use of data arising as a result of your use of the App.
12.5 Disclaimers and limitations of liability in these Terms shall not apply to any damages arising from death or personal injury caused by the negligence of Travelex or any of its employees or agents or for fraud.
12.6 Purchases of currency via the mobile app is subject to the Travelex Online Terms and Conditions and the respective limits of liability set out there.
12.7 By listing information relevant to travel to various destinations, Travelex does not represent or warrant that travel to such destinations is safe, advisable or without risk. Travelex is not liable for damages or losses that may result from travel to such destinations. You are responsible for making your own plans, conducting your own research and you travel at your own risk.
12.8 The features on the App are intended as a guide only. You are responsible for making the correct plans for your trip and Travelex is not liable for any damage or loss that you may suffer due to inaccuracies or omissions on the App.
12.9 Access to Third Party Sites or information is subject to the Third Party Site terms and conditions. You should be aware that they may have certain limits on liability and you responsible for complying with the terms of use of those Third Party Sites.
13. Termination & Cancellation
Travelex may terminate your access and use of any part of the App at any time without notice if you are in breach of any of these Terms or for any other reason. Travelex reserves the right to cease operating the App at any time without notice.
Travelex is entitled to refuse, withdraw or cancel your foreign currency order at any time for any reason, including:
- if we reasonably suspect that your foreign currency order has been placed for speculative gain, investment or business purposes; or
- if there have been significant fluctuations in the exchange rate market following the placing of your foreign currency order.
14. General
14.1 No failure or delay by us to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy.
14.2 You agree that we may sub-contract the performance of any of our obligations or may assign these Terms or any of our rights or obligations without giving you notice. You undertake not to assign, re-sell or in any other way transfer your rights or obligations under these Terms.
14.3 A person who is not a party to these Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms.
14.4 We reserve the right at all times to disclose any information as we deem necessary to satisfy any applicable law, regulation, legal process or governmental request.
14.5 If any provisions of these Terms including any disclaimers and limitations is found to be unlawful or unenforceable then such provisions shall fall away and shall not affect the validity and enforceability of the remaining terms. This does not affect your statutory rights.
14.6 These Terms, the Travelex Online Terms and Conditions, and the Travelex Privacy Policy constitute the entire agreement between Travelex and you regarding the App.

16. Law and Jurisdiction
Our relationship shall be governed and interpreted in accordance with English Law. Any dispute, which cannot be resolved between us, shall be subject to the exclusive jurisdiction of the English courts.
